At NRP Solutions, we are deeply committed to addressing one of the most pervasive yet underreported injustices in Pakistan: the systemic deprivation of women from their rightful inheritance. Despite clear legal and Islamic provisions guaranteeing women’s property rights, cultural norms, patriarchal structures, and deeply entrenched customs continue to deny women their fair share of family wealth. Women in Pakistan do have the legal right to inherit family’s wealth, yet they rarely exercise their rights. In certain societies inheritance is a simple matter of transferring legal possessions of deceased persons to their descendants. According to traditional tribal customs in Pakistan, sons tend to enjoy the right of receiving almost all the assets left by their parents, while women generally do not receive or are obliged to surrender their legal share in inheritance. Being daughters, women are often also expected to forego their rights to inheritance in favour of their brothers. Their claim to get their inherited share in property may result in their desertion by their parental side. All this is mostly done and justified in the name of preserving inherited land, an important source of income and the symbol of power. Dowry is often treated as the daughters’ share in inheritance which obviously, in most cases, is not equivalent to legal. inheritance, but customary practices are binding on women to acquiesce. Moreover, women are told that their brothers are going to take care of them and the gifts given to them on different occasions are considered their share in property.
Under both Islamic law (Shariah) and Pakistan’s statutory legal framework, women are unequivocally entitled to inherit property. The Quran explicitly states: “Men shall have a share in what parents and kinsfolk leave behind, and women shall have a share in what parents and kinsfolk leave behind.” (Quran, 4:7). The Family Laws Ordinance of 1961 further codifies these rights, stipulating that women are entitled to half the share of their male counterparts in inheritance. While this may seem unequal at first glance, it is rooted in the Islamic principle that men bear greater financial responsibilities, such as providing for their families. However, even this reduced share is often denied to women in practice.
In rural Pakistan, where tribal customs and traditional practices hold sway, women are frequently pressured to relinquish their inheritance rights in favor of their brothers. Sons are viewed as the rightful heirs to family land, which is not only a source of income but also a symbol of power and social standing. Daughters, on the other hand, are often told that their dowry—typically a fraction of the value of their legal inheritance—constitutes their share of family wealth. This practice is not only unjust but also contrary to both Islamic teachings and Pakistani law.
