Championing Property Rights for Marginalized Women in Pakistan

According to the 2017-2018 Demographic and Health Survey, 97% of women in Pakistan did not inherit land or housing.

At NRP Solutions, we are deeply committed to addressing one of the most pervasive yet underreported injustices in Pakistan: the systemic deprivation of women from their rightful inheritance. Despite clear legal and Islamic provisions guaranteeing women’s property rights, cultural norms, patriarchal structures, and deeply entrenched customs continue to deny women their fair share of family wealth. Our mission is to empower marginalized women by providing them with the legal representation, education, and support they need to claim their inheritance and secure their financial independence.

Women in Pakistan do have the legal right to inherit family’s wealth, yet they rarely exercise their rights. In certain societies inheritance is a simple matter of transferring legal possessions of deceased persons to their descendants. According to traditional tribal customs in Pakistan, sons tend to enjoy the right of receiving almost all the assets left by their parents, while women generally do not receive or are obliged to surrender their legal share in inheritance. Being daughters, women are often also expected to forego their rights to inheritance in favour of their brothers. Their claim to get their inherited share in property may result in their desertion by their parental side. All this is mostly done and justified in the name of preserving inherited land, an important source of income and the symbol of power. Dowry is often treated as the daughters’ share in inheritance which obviously, in most cases, is not equivalent to legal. inheritance, but customary practices are binding on women to acquiesce. Moreover, women are told that their brothers are going to take care of them and the gifts given to them on different occasions are considered their share in property.

The Legal Framework vs. Cultural Realities

Under both Islamic law (Shariah) and Pakistan’s statutory legal framework, women are unequivocally entitled to inherit property. The Quran explicitly states: “Men shall have a share in what parents and kinsfolk leave behind, and women shall have a share in what parents and kinsfolk leave behind.” (Quran, 4:7). The Family Laws Ordinance of 1961 further codifies these rights, stipulating that women are entitled to half the share of their male counterparts in inheritance. While this may seem unequal at first glance, it is rooted in the Islamic principle that men bear greater financial responsibilities, such as providing for their families. However, even this reduced share is often denied to women in practice.

In rural Pakistan, where tribal customs and traditional practices hold sway, women are frequently pressured to relinquish their inheritance rights in favor of their brothers. Sons are viewed as the rightful heirs to family land, which is not only a source of income but also a symbol of power and social standing. Daughters, on the other hand, are often told that their dowry—typically a fraction of the value of their legal inheritance—constitutes their share of family wealth. This practice is not only unjust but also contrary to both Islamic teachings and Pakistani law.

The Barriers Women Face

The challenges women face in claiming their inheritance are multifaceted and deeply rooted in societal structures:

    1. Cultural Norms and Social Pressure: Women are often expected to prioritize family harmony over their legal rights. Asserting their claim to inheritance can lead to ostracization, abandonment by their natal families, or even violence. The fear of social stigma and familial discord forces many women to remain silent.

    1. Lack of Awareness: Many women, particularly in rural areas, are unaware of their legal rights. They lack knowledge about land registration systems, legal procedures, and the steps required to claim their inheritance. This information gap is exacerbated by limited access to education and legal resources.

    1. Economic Dependence: Women from lower socioeconomic backgrounds often lack the financial resources to pursue legal action. The cost of litigation, coupled with the fear of retaliation, deters many from seeking justice.

    1. Restricted Mobility: Cultural norms often restrict women’s mobility, making it difficult for them to visit courts, land registries, or legal offices. This lack of freedom further hinders their ability to assert their rights.

    1. Male Control Over Property: Even when women do inherit property, it is often managed or controlled by male relatives, leaving them with little to no autonomy over their assets.

The Role of NRP Solutions

At NRP Solutions, we believe that every woman deserves to exercise her legal and Islamic right to inheritance. Our approach is holistic, combining legal advocacy with community education and empowerment initiatives. Here’s how we work to make a difference:

    1. Legal Representation: We provide free or subsidized legal services to women seeking to claim their inheritance. Our team of experienced lawyers specializes in navigating the complexities of inheritance laws and challenging discriminatory practices in court.

    1. Community Engagement: We work with local leaders, religious scholars, and community organizations to challenge harmful customs and promote gender equality. By engaging men and women alike, we strive to shift societal attitudes and create a more inclusive environment.

    1. Policy Advocacy: We advocate for stronger enforcement of existing laws and the introduction of reforms that protect women’s property rights. This includes pushing for better access to legal aid, simplified land registration processes, and stricter penalties for those who deprive women of their inheritance.

The Road Ahead

The fight for women’s inheritance rights in Pakistan is far from over. While the legal framework exists, its implementation is hindered by deeply ingrained cultural practices and systemic inequalities. At NRP Solutions, we are committed to bridging this gap, one case at a time. We envision a future where women are not only aware of their rights but also empowered to claim them without fear or hesitation.

By standing with marginalized women, we are not just fighting for their inheritance—we are fighting for their dignity, their independence, and their rightful place in society. Together, we can challenge the status quo and create a more just and equitable Pakistan.

Join us in this mission. Because every woman deserves her share.
